About these terms

These terms apply when you purchase a build from Willmerce Studios (“Willmerce”, “we”, “us”). By completing checkout, you agree to them on behalf of yourself or the business you represent.

Products and scope

Each Willmerce build is a fixed-scope digital product. The scope, inclusions and standard delivery window of each build are described on its page at the time of purchase. A Full Conversion Build is scoped individually, and its configuration is confirmed in writing before payment.

Willmerce delivers design and front-end files. Implementation into your live website or store, platform configuration and ongoing management are not included.

Pricing and payment

Prices are shown in US dollars and are payable in full at checkout. Payments are processed securely by Stripe. Work begins only after payment has been received.

The project brief and timeline

After payment, you complete a project brief and supply the assets the build requires. The production timeline begins once the completed brief and required assets have been received. Delivery windows are counted in business days. Late assets or delayed feedback move the delivery date accordingly.

Delivery of files

We deliver a first version (V1) for review and, after the revision round, final responsive front-end files suitable for implementation by you or your developer. Files are delivered digitally.

Revisions

Each build includes one structured revision round, submitted as a single, consolidated set of feedback on V1. Revisions are refinements within the approved direction and scope, such as copy adjustments, layout and hierarchy refinements, visual adjustments and fixes.

New pages or sections, changes of product, offer, audience or direction after production begins, and new assets after V1 that change the direction are new scope. Once the included round has been used, an Additional Revision Round is available for $300.

Express Delivery

Express Delivery is priority production with an accelerated schedule. It is subject to current production capacity and is offered only when it is available. Express does not change the scope of a build.

Your responsibilities

You agree to:

• Provide accurate and complete information in the project brief
• Hold the rights to any content, imagery, trademarks and other assets you supply, and permit Willmerce to use them to produce the build
• Provide feedback within a reasonable time
• Arrange and manage implementation of the delivered files into your live environment
• Ensure your final published content complies with the laws that apply to your business

Intellectual property

Upon full payment, ownership of the final delivered files created specifically for your build transfers to you. Assets you supply remain yours. Third-party materials, such as fonts or libraries, remain subject to their own licences. Willmerce may retain general know-how, techniques and non-client-specific components developed independently of your project.

Limitation of liability

Willmerce provides design and front-end files and does not control how they are implemented, hosted or operated. To the extent permitted by law, Willmerce is not liable for indirect or consequential losses, and its total liability in connection with a build is limited to the amount paid for that build. Final wording of this section is pending legal review.

Changes to these terms

We may update these terms from time to time. The version published on this page at the time of your purchase applies to that purchase.
